Couple Furious After No Charges Were Filed Vs Babysitter of Son Who They Found “Black and Blue”

A couple are now fighting for justice after no criminal charges were filed against the babysitter of their one-year-old son, who they found ‘black and blue’ two months ago.

Dad Joshua Marbury took to social media his fury after he and his partner, Alicia Quinney, came home from a night out to find their one-year-old son, Jacob, screaming and seemingly in pain, while the babysitter was asleep on the couch.

However, the next morning, when they awoke, they were shocked to find their son bruised and scarred.

“The first thing I saw was a black eye. “I thought maybe marker got on his face or something. When he turned over, his whole right side of his face — black and blue,” Ms Quinney told Oregon Live.

She added that she also saw marks on the child’s right ear, arm and back.

The couple then reported the incident to police, but weeks passed by and no criminal charges were pressed against the babysitter.

So, Mr Marbury decided to upload the images of his badly bruised baby on Facebook which has since gone viral.

Oregon Live reported that in Mr Marbury’s post, he said that despite several doctors saying that there was a handprint on his son’s face and that detectives said the incident “could have killed” the baby, and that the babysitter confessed to the couple, he wrote that the babysitter “was not arrested” because they were told that a case and a jury have to be built to find the babysitter guilty.

He also got furious after being told that the case had been dropped two months later because his baby “cannot speak for himself.” He wrote:

“After TWO months of waiting we only find out that charges are dropped BECAUSE my one year old cannot tell you verbally he was abused and my son did not show he was in pain OR that this person “intentionally” did this.”

Mr Marbury was refering to the 2012 Oregon Court of Appeals ruling that prosecutors say it is more difficult to file charges in abuse cases with victims who can’t speak, and the accused abuser is protected by this ruling that discourages prosecutors from filing charges since the baby can’t speak about the alleged attack. In a fit of rage, Mr Marbury also wrote as part of the post which pointed out to the ruling.

“DO YOUR PART, you have a verbal confession and evidence showing a hand print!!!! A dead body cant tell you who killed them. Yet a baby isnt held to the same standard because he cant talk???? Well neither can a dead body. THATS BLASPHEMY.

“NOBODY can just hit a child and more to just get away with it because the child cant verbally tell you,” Mr Marbury said.

The post has now over 300,000 shares.
